Military Survivor Benefit Plan. A common concern of a divorcing member is her or his ability to name a future spouse as a Survivor Beneficiary. Is it possible under the Military Survivor Benefit Plan (SBP) to name a former spouse and then at a later date designate a new spouse to the balance of the SBP?
No. This action is barred by 10 U.S.C. 1450(a)(1). A member who names his Former Spouse at the time of divorce is not permitted to add a subsequent spouse upon remarriage.
