DIVORCE – QDRO
COLLECTING A PENSION AFTER THE PARTICIPANT RETIRES
Question.
I am divorced. I did not get a QDRO. Now my ex-spouse is retired. Is it too late to get my share of his pension?
CAN A QDRO BE ISSUED AFTER THE DIVORCE?
CAN A QDRO BE ISSUED MANY YEARS AFTER THE DIVORCE?
Answer: YES!!!!
Based on Federal Regulations there is no time limit for the filing of a Domestic Relations Order. This means that a former spouse, years after a divorce and failure to promptly file the Domestic Relations Order, continues to have the right to file and obtain a portion of her ex-husband's pension benefits.
This is true for both pensions payable as a monthly benefit and 401(k) type plans, payable as a single lump sum.
